NOTICE TO USERS

The user declares that they accept the characteristics and limitations of the Internet and, in particular, they acknowledge that:

  • They are aware of the nature of the Internet, its technical performances and the response time for consulting, interrogating or transferring data and information;
  • Data circulating on the Internet is not necessarily protected, in particular it is not protected against possible interception or misappropriation;
  • If the user communicates their user id and password or any information that they regard as being personal or confidential to third parties, they do so entirely at their own risk and peril;
  • The user will be responsible for taking all the appropriate measures to protect their own data and/or software against any possible contamination by viruses present on the Internet;

The user is solely responsible for its choice, use and interpretation of the data that it consults, interrogates and transfers on the Internet, and its use of the online services proposed by NOVISCORE, which cannot be held liable on any score whatsoever.

NOVISCORE makes every effort to offer users the information and/or tools available and ensure that appropriate checks in respect of these have been duly carried out, but cannot be held responsible or liable for errors, the unavailability of information and/or the presence of viruses on its site.

DATA PROCESSING AND INDIVIDUAL LIBERTIES, THE PROTECTION OF PERSONAL DATA

Mere consultation of the www.noviscore.fr site will not give rise to the recording of any data of a personal nature. However, in the event of subscription to an electronic service, regardless of whether the service is provided free of charge or in return for payment, NOVISCORE will collect from each user a certain amount of obligatory data of a personal nature (name, address, contact details, etc.). Similarly, if it receives a request for information or documentation, NOVISCORE may be led to use this data for the purposes of answering the said request.

NOVISCORE guarantees that no data of a personal nature will be collected without the user’s having been informed to that effect beforehand, and guarantees that no personal information gathered online will be transferred to third parties. However, personal data may be used for the purposes of sending information and exclusive NOVISCORE promotional offers. Our company is the sole recipient of any information that you communicate to us.

NOVISCORE respects the provisions for the protection of human rights and fundamental freedoms, the protection of personal data and the free circulation of such data, and complies with EU Directive no. 95/46 and Act no. 78-17 of 6 January 1978 concerning data processing, data files and individual liberties, (modified by the Act of 6 August 2004 concerning the protection of individuals in the context of the processing of personal data). To that end the company has gone through the appropriate procedures and obtained the requisite legal and administrative permits, and duly submitted a declaration to the Commission Nationale Informatique et Libertés (the CNIL, the French data-processing watchdog) concerning its processing of personal data.

The user is informed in particular that, in accordance with Article 27 of Act no. 78-17 of 6 January 1978 concerning data processing, data files and individual liberties, they benefit from rights in respect of access to personal information concerning them and its rectification or deletion. These rights may be exercised by sending an e-mail to the following address: contact@noviscore.fr, or by sending a letter by post to NOVISCORE SARL (cnil), 76 chemin de l'Androune, Mas de Mouton, 30630 Verfeuil, France.

COOKIES

NOVISCORE hereby informs the user that cookies will be installed. A cookie does not enable an individual to be identified but enables information concerning a computer's browsing to be recorded (the pages consulted, the date and time when they were consulted, etc.) which NOVISCORE can read on the occasion of subsequent visits. These cookies are not recorded on NOVISCORE's server but only on the user’s computer.

Use of NOVISCORE’s online service is subject to the client’s acceptance of cookies. NOVISCORE respects its visitors’ privacy and treats this respect as a priority; it points out that these cookies are exclusively intended to allow it to know how many visitors go to its site, and in no case is intended to enable it to fraudulently gather personal data. If the user refuses to allow cookies to be stored, no orders can be processed and no transactions can take place. The length of time for which such information may be kept in the computer is a maximum of one year.

INTELLECTUAL PROPERTY RIGHTS

The general structure of the site as well as the software, texts, images, sounds, graphics and videos of which it is made up, as likewise all elements of editorial content, are the exclusive property of NOVISCORE, or lawfully exploited by it with the permission of the copyright holders. Any total or partial presentation or reproduction of this site by any process whatsoever which has not been expressly authorized by NOVISCORE in advance is prohibited and would constitute infringement and be liable to be sanctioned as such under the terms of the Intellectual Property Code including, in particular, the penal sanctions set forth in Articles L.335-2 et seq..

All documents, texts, works and illustrations placed online by NOVISCORE are copyrighted and are protected by the law protecting the databases of which NOVISCORE is the producer within the meaning of Articles L.341-1 et seq. of the Intellectual Property Code.

The NOVISCORE trademarks and those of its partners, as likewise the logos featured on its site, have been officially filed and/or registered. Any total or partial reproduction or representation of these trademarks, as likewise any modification or altering of these trademarks and/or logos without prior permission from NOVISCORE and/or the holders of the said trademarks or logos, is prohibited.

HYPERLINKS

Hyperlinks may direct the user to Internet sites other than the www.noviscore.fr site; NOVISCORE declines to accept any liability with respect to such sites and their content. In particular NOVISCORE, which does not publish these sites, cannot be held liable for any failure on the part of these sites to comply with the legislation or regulatory provisions in force, or failure to respect the rights of third parties.

NOVISCORE’s prior authorization is necessary before anyone can publish or create a hyperlink to the www.noviscore.fr site.
